FISA

The motion to lay before the Senate the message on S.139, FISA, was agreed to by a vote of 68-27. Senator McConnell then moved to concur in the House amendment to S.139 and filed cloture on the motion. We expect the cloture vote to occur at 5:30pm on Tuesday.
 
Senator McConnell made a motion to concur in the House amendment with an amendment and filled the amendment tree and made a motion to refer the bill to the Judiciary Committee with instructions and filled the amendment tree.
 
If cloture is invoked on the motion to concur, debate would be limited to up to 30 hours of post-cloture debate. Upon the use or yielding back of time, the Senate would dispose of any pending amendments and motions and then vote on the motion to concur (passage).
 

As a result of cloture being filed, there are filing deadlines for first and second degree amendments with respect to S.139. We expect to set the filing deadlines for first degree amendments for 4:45pm on Tuesday and second degree amendments for 5:15pm on Tuesday.
